New Mexico property owners have a legal duty to anyone who is injured on their property. That duty will be higher for those invited to visit (e.g., customers) as opposed to those who are not (i.e., trespassers). When either a defective design on the property or its faulty upkeep causes someone to be injured, then all those responsible for that property may be liable for that harm.
Those legally responsible for the injury can include owners and managers of hotels, motels, school dorms, concert halls, grocery stores, amusement parks, churches, airports, or even someone's apartment. If their failure to provide adequate security unfortunately results in someone's rape, assault, or murder, then this same law of premises liability makes them legally accountable for it.
Premises liability claims include:
- slip and fall or trip and fall injuries
- injuries from falling merchandise
- injuries from unsafe elevators or escalators
- injuries from providing inadequate or improper security
